Created on Thursday, May 18, 2017 12:00 AM कुलभूषण जाधव केस में ICJ के फैसले पर श्री आनंद शर्मा ने कहा कि आज भारत को अंतर्राष्ट्रीय अदालत में राहत मिली है, इसका हम स्वागत करते हैं। लेकिन ये लड़ाई अभी लंबी हैं, हम यही अपेक्षा करते हैं कि पाकिस्तान इससे एक संदेश लेगा और आने वाले समय के अंदर जो भी कहा गया है अदालत के द्वारा, उस पर अमल करेगा। संयुक्त राष्ट्र संघ को भी ये देखना होगा कि पाकिस्तान किसी भी तरह से कोई व्यवधान ना डाले और जो अदालत ने एक दृष्टिकोण लिया है उसका सम्मान करे।

श्री शर्मा ने कहा कि एक दरवाजा खुला है लेकिन ये एक ऐसा विषय था जिस पर भारत के पास शायद और कोई रास्ता नहीं था, पाकिस्तान की मानसिकता को देखते हुए। एक तरफा मिल्ट्री कोर्ट से फैसला कराया, काउंसलर ऐक्सेस नहीं दी, जो लीगल असिस्टेंस मिलनी चाहिए थी, वो नहीं दी गई। भारत को मजबूरन वहाँ जाना पड़ा Vienna Convention के परिपेक्ष्य में। कुलभूषण जाधव के केस में ये स्पष्ट है कि Vienna Convention का उल्लंघन हुआ था, पाकिस्तान के द्वारा।

On the reaction of the Congress Party on the verdict by the International Court of Justice on Shri Kulbhushan Jadhav’s case, Shri Sharma said it is a matter of great relief for all the people of India. We were worried. The orders of the International Court of Justice must be respected by the State of Pakistan. Pakistan’s argument before the International Court of Justice and its refusal to accept its jurisdiction betrays a mindset of disrespect to the Vienna Convention which Pakistan has brazenly violated.

Shri Kulbhushan Jadhav was unfairly denied access to Counselor officials or to legal assistance. The International community must put pressure on Pakistan. The United Nations have to take a serious note. Pakistan’s contention before the International Court of Justice that this case was taken to the Military Tribunal because there was issue of terrorism, it is not so and this is a lie. He was a civilian, businessman irrespective that he may have served in the Defence Services prior to the retirement. He was abducted and Pakistan to wipe its face off so many pop marks of terrorism,it tried to present it as justified case of action. Even in the case of the noted terrorist who had come fully armed, attacked the citizens of this country, killed hundreds including our foreign guests, the terrorist was given not only a fair trial but in a Civilian Court of Law, not denied legal assistance and given all access. So Pakistan has no legs to stand upon. We hope that the Government of India will continue to mount that pressure because it is the first stage. We have to ensure that Jadhav’s life is saved and only when he returns home, we will celebrate. Right now, it is a big relief, first step and we hope that Pakistan respects that order.

Shri Sharma said Shri Harish Salve and his Legal Team represented the country well that India has been able to very clearly convey that this was a case of violation and there was a need for ICJ to intervene. But this is a battle that shall continue.
